Imran Khan's request to withdraw appeal against Tosha Khana reference decision rejected


The founding chairman of Pakistan Tehreek-e-Insaaf (PTI) wanted to withdraw the party's appeal against a ruling related to the Tosha Khana reference. However, the Islamabad High Court, led by Chief Justice Aamir Farooq, rejected this request.


In January 2023, PTI Chairman's lawyer, Barrister Ali Zafar, filed a plea, stating that a petition in Lahore challenged the Election Commission's decision in the Tosha Khana case. The High Court was considering this matter.


During the hearing, PTI expressed a desire to move the case from Islamabad High Court to Lahore High Court, where a five-member bench was assembled for this type of case. The Election Commission's representative argued that since the initial appeal was filed in Islamabad, that court should handle the hearing.


The case continued until September 2023 when Chairman PTI's lawyer submitted a new application. Chief Justice Amir Farooq assured, "We will hear your pending application soon." The court postponed the decision on this petition after arguments on September 13.


Recall that on October 21, 2022, the Election Commission had declared Imran Khan, the founder and chairman of PTI, ineligible for the legislature.


While the case was ongoing in Lahore High Court, Imran Khan had requested to drop the appeal. On January 18, 2023, the founder chairman submitted a formal request to withdraw the appeal. The court, after considering arguments from both sides, delivered the verdict on September 13, 2023.
